News just in from Mark Henderson, the barrister behind the Zimbabwe test case litigation, is that HS is appealing the negative decision of the tribunal in his case, which was used as a test case for all Zimbabweans currently in the UK.  Permission to appeal sounds like it was refused on the papers but was due to be renewed orally on 20 May 2008. That hearing was adjourned at the request of the Home Office for them to consider their position, and the hearing has now been set down for 2 July 2008.

Free Movement will be away then, so I’m afraid readers will need to get their Zimbabwe news elsewhere in July and August.

    What constitute to a final decision in HS(Zimbabwe )?The Administrative Court has more than 800 cases that were allowed by the AIT Judges and later upheld by Senior Immigration Judges.For years now the Administaritve Court says they need a final decision in HS ,to hear these cases.If a Senior Immigration Judge orders reconsideration,then one must count his/her luck stars.
    What constitute to a final decision in HS(Zimbabwe ) for the cases at the Administarive Court to be heard?

    I really don’t think there will be a final decision in these cases until Mugabe goes, and whether that will happen at the upcoming election is anyone’s guess.
