I heard today in court that the reason why second stage reconsideration cases are being brought forward is because after 15 February 2010 when the Asylum and Immigration Tribunal is scrapped, all such cases have to be heard by relatively senior judges. Although I’ve been doing some work on how the new system will operate, I had not put two and two together on this front. There is already a significant backlog, and this will clog up the system for quite some time by the sounds of things. Anyone whose second stage reconsideration hearing is still pending on 15 February can therefore expect a long wait.
