Fees for judicial review applications hare risen yet again from today, Monday 25 July 2016. A new fees order was quietly laid last Friday: The Civil Proceedings, First-tier Tribunal, Upper Tribunal and Employment Tribunals Fees (Amendment) Order 2016. The fees going up are for the permission stage and they rise by 10%. Other fees remain as they were.

There is no convenient and accessible list of the different fees for Upper Tribunal judicial review applications, so I thought it might be useful to put them together into a blog post. Why the Upper Tribunal cannot do this on their website I do not really know, but it turns out the President does attach a schedule of fees to the case of R (on the application of Spahiu & Anor) v Secretary of State for the Home Department (Judicial review – amendment – principles (IJR) [2016] UKUT 230 (IAC). That will of course be out of date from next Monday.

A simplified and updated version of that table is reproduced below for convenience:

Description Old fee New fee
Permission to apply for judicial review (or permission to proceed if not begun by JR procedure) £140 £154
Application reconsider a refusal of permission £350 £385
To proceed to a full hearing if permission is granted (to be paid within 7 days of service of the order granting permission) £700 (£350 if reconsideration fee already paid) £770 (£385 if reconsideration fee already paid)
On an application on notice where no other fee is specified £255 £255
On an application by consent or without notice where no other fee is specified (not payable in relation to an application by consent for an adjournment of a hearing where the application is received by the Tribunal at least 14 days before the date set for that hearing) £100 £100
On an application for a summons or order for a witness to attend the Tribunal £50 £50
On a request for a copy of a document filed for the purposes of immigration judicial review proceedings in the Tribunal £10 for 10 pages or less then 50p per page £10 for 10 pages or less then 50p per page
On a request for a copy of a document on a computer disk or in other electronic form, for each such copy. £10 £10

If it looks like the table has any mistakes or omissions, let me know and I will update.
