The Lib Dems have tabled an objection to the latest Immigration Rules changes, covered earlier here on the blog. Under the ‘scrutiny-lite’ negative resolution procedure by which the rules become law there will therefore, unusually, be a debate in Parliament on the new rules. Although on past form probably not until after they have taken effect.

I can only assume that the educational lobby is behind this, rather than any point of principle the Lib Dems have suddenly fixed on. As discussed earlier, universities are being very hard hit on two fronts right now. Central government is slashing direct funding, while UKBA has also slaughtered the cash cow that were foreign students. Part of the cut-backs to the numbers of foreign students is no doubt deliberate, but a lot of it also seems to be through accident and incompetence. A lot of genuine and entirely bona fide students and highly skilled workers are being caught out by the silly bureaucratic requirements of the Points Based System. We immigration lawyers are simultaneously horrified at some of the ridiculous decisions and inflexibility of the Points Based System while also, it has to be said, experiencing an increase in demand for our services.

I’ve said it before and I’ll no doubt say it again: I think the Home Office secretly love immigration lawyers.

  1. the new tier 4 is mad. I’ve seen cases refused where the person is the clearest possible example of a genuine student, and some allowed where the only possible reaction is, “pull the other one….”

  2. We can’t do anything now except abiding by the rules, I can call myself the clearest case of a genuine student still the Visa has been refused twice, wasted my 3 months as my course is delayed and even a lot of money in Visa Application Fees…

    We are COMMON PEOPLE (Mango People == AAM Janta {in hindi}), all we can do is to abide by their rules and do as they ask us to do after all it is we who wants to study in UK and make a good career, they are least bothered about refusals and all as they have tons of student applying every other day from all over the world. UK’s image is getting spoiled day by day and that is clearly visible on various popular Visa Advice Forums like immigrationboards.com and sites like http://www.adviceforyou.org.uk/ It feels at various occasions are the ECOs in BHC are brainless merciless and heartless robots who just do as they are PROGRAMMED to and don’t have any of their brains at all to understand the genuineness of a student before giving a refusal to them..

    But still, All I would say, LETS Abide by their rules and hope that everything goes well, I have submitted my third time application a few days back in the month of June 2010. I am hoping to get a positive response this time.
