A blog post I wrote dated 11 January 2018 regarding visit visa appeals in the Court of Appeal could be read as implying a failure by leading and junior counsel for the Secretary of State Lisa Giovannetti QC and Colin Thomannc to bring to the attention of the Court of Appeal what was at the time the leading authority on this issue in the Upper Tribunal, the case of Mostafa, in a case in which the opposing party was unrepresented. I apologise unreservedly for writing something that could be read as suggesting that and have corrected the blog post in question. The Mostafa case was cited in the Secretary of State’s skeleton argument and included in the authorities bundle and any decision not to cite the case was that of the Court of Appeal.
